SMALL AND MEDIUM-SIZED BUSINESSES

The law establishes the concept of small and medium-sized business, which, in accordance with Article 4 of Federal Law # 209-FZ dated 24.07.2007 "On development of small and medium-sized business in Russian Federation", include:

  • the citizens registered in the established manner (as individual entrepreneurs (IE) or heads of peasant households (farms);
  • consumer cooperatives and commercial organizations registered in the established manner (except for state and municipal unitary enterprises).

SMALL AND MEDIUM-SIZED ENTITIES SHALL MEET THREE CRITERIA:

CRITERION 1. CAPITAL PARTICIPATION FOR LEGAL ENTITIES

The total share of the Russian Federation, the Russian Federation constituent entities, municipalities, public and religious organizations (associations), charity and other funds should not exceed 25% in the legal entity authorized (joint-stock) capital (share fund).


The exception is provided by:

1. The assets of joint-stock investment funds, closed-end mutual investment funds and investment partnerships.

The capital participation for foreign legal entities, one or more legal entities that are not small and medium-sized enterprises shall not exceed 49% each.


2. Economic companies (business partnerships), engaged in the practical application (implementation) of the intellectual activity results, the exclusive rights for which belong to the following types of founders:

  • budgetary independent scientific institutions;
  • budgetary institutions, independent institutions, institutions of higher education;
  • legal entities, the founders (participants) of which are the legal entities included in the list of legal entities that provide state innovation activity support, approved by the Russian Government, provided that certain criteria are met.

3. Legal entities that have received the status of a project participant in accordance with Federal Law # 244-FZ dated September 28, 2010 “On Skolkovo Innovation Center”.


CRITERION 2. BY AVERAGE NUMBER OF EMPLOYEES

The average number of employees for the previous calendar year shall:

  • range from 101 to 250 people inclusive, for medium-sized enterprises;
  • not exceed 100 people for small enterprises, and 15 people for microenterprises.

The average number of microenterprise, small enterprise, or medium-sized enterprise employees for a calendar year is determined taking into account all the employees, including those employed under civil law contracts or working part-time with account of actual working hours, the employees of representative offices, branches and other separate divisions.

CRITERION 3. BY REVENUES FROM SALE OF GOODS (WORKS, SERVICES)

The revenues from the sale of goods (works, services) excluding VAT or the book value assets (the residual value of fixed assets and intangible assets) for the previous calendar year shall not exceed:

  • RUR 120 m for microenterprises;
  • RUR 800 m for small enterprises;
  • RUR 2,000 m for medium-sized enterprises.

Comprehensive advisory support for the Moscow small and medium-sized enterprises is provided by the Small Business of Moscow State Budgetary Institution.

Consultations on topical issues are provided to companies of different business development cycles.

Startup entrepreneurs can get the information support on the issues of company registration, legal requirements for various types of activities, as well as the financial support for small and medium-sized businesses, business education.

Developing companies can get the advisory support on preparing a document package to obtain various types of financial support, and learn about opportunities in promoting goods and services to regional and international markets.

In addition, in the district divisions provide information regarding the labor protection requirements, hold free seminars and lectures on topical business administration issues.

PROMOTION AND SALES

In Moscow, on the basis of SBI Small Business of Moscow, a Unified State Order Center was created, where the representatives of small and medium-sized enterprises can receive free information support, which includes:

  • face-to-face and correspondence consultations;
  • seminars, round tables, forums;
  • clarification of the tender documentation provisions;
  • turnkey preparation of applications for state and municipal order participation;
  • a set of guidance materials, memos, instructions;
  • a weekly electronic newsletter on the procedures planned by state customers;
  • participation in the Center media projects;
  • thematic meetings with customers in Moscow;
  • meeting room provision.
